Dishonour of a cheque...

One can file a Criminal Complaint  for recovery of the cheque amount along with the cost & interest u/s 138 of  Negotiable Instrument Act  for punishment to the signatory of the cheque for haring committed an offence. However, before filing the said complaint a statutory notice is liable to be given to the other party.

About Bail...

Bail is given to accused once the charge sheet is framed by police and there is no other possibility were the accused tampered with the witnesses. The main purpose of putting accused in jail as to he might influence the witnesses; so once the charge is frame, and the trial is started court will grant bail to accused.
